[music]Hi, Im Mark LeWinter.
A manufacturer is responsible for the safety of its product. It must ensure that the product is safe for its intended use and purpose. The product must contain all elements that are necessary to ensure its safe use.
A product may be unsafe for three reasons. First, it may be defective in its design. Second, it lacks proper warnings for safe usage. Third, it contains a defect that was present at the time it was manufactured.
Great care must be taken to ensure that all legal hurdles will be cleared in product liability litigation. Not all products are defective simply because they're dangerous. The court must weigh its usefulness against the danger it imposes and determine whether there is an alternative safe design.
